1. Agreement to These Terms

These Terms & Conditions ("Terms") govern your use of the kumlehn-frank.life website and any hosting, website design, or support services provided by Kumlehn-Frank Web Design & Hosting ("we", "us", "our"). By using this website, submitting a sign-up form, or signing a service agreement with us, you agree to these Terms.

Where you sign an individual Service Agreement (contract) with us for hosting, design or support, that agreement sets out the specific services, pricing and terms for your account. If anything in your signed Service Agreement conflicts with these general Terms, the signed Service Agreement takes priority.

2. Our Services

We offer the following services, described in more detail on our pricing page:

• Website hosting — SSD hosting plans, billed monthly, with optional domain registration and renewal.
• Website design — once-off design and build of a website, delivered ready to launch.
• Update retainer — an optional, ongoing monthly service for content edits and small changes to a site we've built.
• Support — ad-hoc support requests submitted via our support ticket form.

3. Pricing & Payment

Current pricing for hosting and design is published on our pricing page and is confirmed in writing at sign-up or in your Service Agreement. Fees for recurring services (hosting, domain renewals, the update retainer) are billed in advance; monthly fees are due within 7 days of invoice. Late payment may result in suspension of the affected service until payment is received. All fees are quoted in South African Rand (ZAR) and are exclusive of any bank or payment gateway charges, which are for the client's account.

Online payments are processed securely through PayFast. We do not store your card or banking details — these are handled directly by PayFast under their own terms and security standards. See our Refund & Cancellation Policy for how refunds are handled.

4. Client Responsibilities

You agree to:

• Provide accurate, current contact and billing information;
• Use hosted services lawfully, and not to distribute malware, spam, or unlawful content;
• Keep any account credentials (client portal login, etc.) confidential; and
• Respond to reasonable requests for content or approvals needed to deliver design work.

We reserve the right to suspend or terminate services that are used unlawfully or that place our infrastructure or other clients at risk.

5. Availability & Liability

We make reasonable efforts to keep hosted sites available and secure; no specific uptime percentage is guaranteed. To the extent permitted by law, our liability under these Terms and any Service Agreement is limited to the fees paid by the client in the three (3) months preceding any claim, and excludes indirect or consequential loss.

6. Term & Cancellation

Recurring services (hosting and/or the update retainer) run on a month-to-month basis from the date your Service Agreement is signed. Either party may cancel recurring services with 30 days' written notice by email. Full details, including how once-off design fees and domain renewals are treated, are set out in our Refund & Cancellation Policy and in your signed Service Agreement.

7. Intellectual Property

Once a website design project is paid for in full, ownership of the delivered site files and design transfers to the client, excluding any third-party assets (stock imagery, fonts, plugins, or licensed software) which remain subject to their own licence terms. We retain the right to showcase completed work in our portfolio unless you ask us not to.

8. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. The "Last updated" date above shows when these Terms were last revised. Material changes affecting an active Service Agreement will be communicated to affected clients by email.
